Rahul Gandhi Wants To Throw Muck At PM Modi But Won’t Do It Outside Parliament. Here’s Why
Both the houses of the Parliament got adjourned today, again. The whole winter session has been a washout so far. Today, Congress Vice President Rahul Gandhi briefed the media. In the press conference, he declared that. “I have some personal information on PM Modi, which is what I want to speak on in Lok Sabha, but I am not being allowed to speak.”
Does Rahul Gandhi really have some muck to throw at the Prime Minister or is he simply indulging in theatrics? No one is sure. However, if the personal information on the prime minister is really that serious, Mr Gandhi should tell the media and the country what it is. Clearly, he isn’t doing that. So, why does he want to reveal this secret information only in the Parliament and not outside its four walls?
The answer is simple: Parliamentary privileges. Every member of the Parliament enjoys near absolute freedom of speech. They are protected under the constitution for whatever they say on the floor of the both houses.
Here’s what section two of the article 105 says:
No member of Parliament shall be liable to any proceeding in any court in respect of anything said or any vote given by him in Parliament or any committee thereof, and no person shall be so liable in respect of the publication by or under the authority of either House of Parliament of any report, paper, votes or proceedings.<i>Constitution Of India</i>
The issue is simple: Gandhi doesn’t want his goose to be cooked in courts, hence he is looking for amnesty in Parliament. He wants the shield of parliamentary privileges in case the Prime Minister or his party goes after him legally and file a defamation case in courts.
