The Delhi Police has told the Delhi High Court that no case has been registered against the man who called Alt News co-founder Mohammed Zubair a ‘jihadi’ in a tweet in 2020.
The tweet in question was made by one Jagdish Singh, who filed a complaint against Zubair and accused him of causing cyber sexual harassment of his grand-daughter.
The Delhi Police has said that nothing incriminating came out for further proceedings or action against Singh who had commented “Once a jihadi is always jihadi” on Zubair's tweet on April 18, 2020.
The police said that Singh’s tweet does not cause fear or alarm to the public and that is why no case has been registered against him.
“Thus, the captioned tweet by the complainant Mr. Jagdish Singh and his examination in this regard has revealed that the captioned tweet on 18.04.2020 does not cause fear or alarm to the public or any section of the public whereby any person may be induced to commit an offence against any state or against public tranquility," the Delhi Police said, Bar and Bench reported.
"That in view of above, no case has been registered in relation to the captioned tweet against the complainant i.e. Mr. Jagdish Singh,” it added.
The status report was filed after the High Court pulled up the police for failing to act against Singh and instead filing a first information report (FIR) against Zubair.
The tweet read, “Hello Jagdish Singh. Does your cute grand daughter know about your part time job of abusing people on social media? I suggest you to change your profile pic.”
In the FIR lodged in Delhi, offences under the POCSO Act, Section 509B of IPC, Sections 67 and 67A of the Information Technology Act were invoked against Zubair.
Later, in an affidavit filed before the High Court, the Delhi Police said it has not named Zubair in the chargesheet because it did not find any criminality against him.
However, the high court pulled up the Police for failing to act against Singh who had made “hate speech” against Zubair.
The Court had also directed the Deputy Commissioner of Police, Cyber Cell to file a status report on the investigation carried out in this case.
