The Maharashtra Verdict Is Here: SC To Pronounce Judgment Today

The Supreme Court on Wednesday, while hearing the ongoing matter related to the same-sex marriage case, revealed that it would deliver the judgement in the pending Shiv Sena dispute on Thursday (11 May).

CJI DY Chandrachud, made the announcement of pronouncing the two major constitutional bench judgements on the issues surrounding the Shiv-sena dispute and the Delhi Govt Vs Lieutenant Governor (LG) issue, while conveying to Senior Advocate Abhishek Manu Singhvi that the argument in the same-sex marriage case can commence on Thursday at about 12 noon only, as it is a crowded morning on the day.

Notably, in the Shiv Sena issue, the first petition was filed by Eknath Shinde in June 2022 challenging the notices issued by the then Deputy Speaker against the rebels under the tenth schedule of the Constitution over alleged defection.


Similarly, in the issue pertaining to the tussle over control of administrative services between the Delhi government and the LG, In February 2019, a two-judge bench of the Supreme Court had delivered a split verdict on the question of powers of the GNCTD and Union Government over services and referred the matter to a larger bench, which was further referred to a Constitution Bench.

These cases were heard by a 5-judge bench comprising CJI DY Chandrachud, Justice MR Shah, Justice Krishna Murari, Justice Hima Kohli and Justice PS Narasimha.

On February 17, the Election Commission had passed an order giving recognition to the faction led by Eknath Shinde as the official one and allowed them to use the party symbol apparatus.
