Senior Congress leader P Chidambaram who is currently in CBI custody, today (26 August) suffered a setback after the Supreme Court dismissed his bail petition in the INX Media Scam after deeming it infructuous.
While arguing for Chidambaram in the petition against Delhi High Court’s dismissal of his anticipatory bail plea, his lawyers Abhishek Manu Singhvi and Kapil Sibal claimed that their client had a right to be heard by the SC before arrest.
Singhvi continued by arguing that the arrest was made despite the matter being listed before the court on Friday (23 August), thus it should restore the status quo.
The plea though was dismissed by the SC bench of Justices Bhanumati and Bopanna who said that the court cannot entertain this bail plea as Chidambaram’s arrest has already taken place.
The bench added that Chidambaram can feel free to move a bail application before any competent court.
After the setback, Sibal began arguing in a petition to prevent a similar crackdown by the Enforcement Directorate (ED).
