Allegations have surfaced claiming that Swati Maliwal, the former chairperson of the Delhi Commission for Women (DCW) had appointed 223 contractual employees without proper permission, in violation of the rules.
The Delhi Lieutenant Governor V K Saxena has now ordered the immediate removal of 223 contractual employees from the DCW, as per a report by Hindustan TImes.
The Department of Women and Child Development stated that AAP leader Swati Maliwal had hired these employees on contract without the government's permission and against established rules.
According to the order, the DCW violated the statutory provisions of the DCW Act, 1994, and various standing instructions of the Department of Finance & Planning Department, GNCTD.
The commission created 223 posts and engaged staff without conducting a study to assess the actual requirement of additional staff and eligibility criteria for each post.
Additionally, no administrative approval or expenditure sanction was obtained from the GNCTD for engaging such manpower, applications for the posts were not formally invited, and roles and responsibilities for the posts were not assigned. Moreover, the emoluments of some incumbents were enhanced sharply and arbitrarily at the time of initial appointment.
The order further states that due to these irregularities and illegalities, the appointments of contractual staff engaged in DCW without sanctioned posts and without following due procedures are void-ab-initio and cannot be allowed to continue.
Consequently, the approval of the government has been conveyed to discontinue the services of all contractual staff appointed by DCW, who have been appointed beyond its delegated power and without following the procedures laid down in violation of DCW Act/rules/regulations/guidelines issued by the government of NCT of Delhi.
