No Relief For Congress As Delhi HC Dismisses Party's Fresh Pleas Against Income Tax Reassessment Proceedings

The Delhi High Court on Thursday (28 March) dismissed fresh pleas filed by Congress against Income Tax proceedings initiated against it.

A division bench of Justices Yashwant Varma and Purushaindra Kumar Kaurav rejected the petitions after both the Congress as well as the IT Department agreed that the latest petitions stand covered by the judgment recently pronounced by the Court with regard to certain other assessment years.

Earlier on 22 March, the court had dismissed three petitions filed by Congress observing that the political party had chosen to move the court only a few days before the time for completion of assessment would expire and at the “proverbial fag end of the proceedings".

The latest four petitions for other assessment years in relation to which IT Department has initiated fresh scrutiny, were dismissed by the Court on similar terms today.

They concerned the assessment years 2017-18, 2018-19, 2019-20 and 2020-21.

Earlier, the Court had upheld the order passed by the Income Tax Appellate Tribunal (ITAT) on 8 March refusing to stay a demand notice issued to the political party for recovery of outstanding tax of more than Rs 100 crore for the assessment year 2018-19.
